Terms of Service

Karls Technology is the operator and developer of ServiceBookr (“ServiceBookr,” “we,” “us”). These Terms have three parts: marketplace & customer terms (Part A), provider & independent contractor agreement (Part B), and platform & app terms (Part C).

Part A - Marketplace & Customer Terms

A1. Acceptance

By using this site, submitting a service request, or otherwise using ServiceBookr, you agree to these Terms and the Privacy Policy.

A2. What ServiceBookr Is

ServiceBookr is a marketplace platform connecting customers who need computer repair and IT services with independent service providers who decide for themselves whether to accept each request.

A3. Appointment Requests & Cancellation

Submitting a request is not a confirmed appointment until an independent provider accepts. Providers manage their own schedules. To cancel penalty-free, notify us before the end of the prior business day. Cancellations made after an independent provider has confirmed your visit may incur a standard platform cancellation fee or provider travel fee as outlined during request confirmation.

A4. Travel & Surcharges

Independent providers manage their own travel and operational expenses. Any applicable travel surcharges or administrative processing fees are itemized and presented upfront prior to provider confirmation.

A5. Invoicing & Payment

ServiceBookr securely facilitates payment processing on behalf of independent providers upon work completion, or providers may invoice clients directly using their own merchant processing. Payment is due upon completion of services unless otherwise agreed in writing.

A6. Providers Are Independent Businesses

Providers are independent business owners. ServiceBookr does not employ providers, does not supervise how they perform the work, and does not guarantee their services beyond operating the technology platform that connects your request. Disputes regarding the quality or outcome of on-site work are directly between you and the provider; you may also contact us for platform support assistance.

A7. Customer Conduct

You agree to provide accurate information, a safe work environment, and lawful use of the site. You will not harass providers or misuse contact channels obtained through ServiceBookr.

Part B - Provider Terms (Independent Contractor Agreement)

B1. Declaration of Independent Business Status

Provider acknowledges and agrees that they are an independent contractor and independent business enterprise, not an employee, agent, or partner of Karls Technology or ServiceBookr. Provider maintains full control over the means, methods, sequencing, and tools used to complete services. Provider is solely responsible for federal, state, and local taxes, business licenses, insurance, and bears the full risk of business profit or loss. Compensation is based on completed deliverables rather than time-based wages or minimum volume guarantees.

B2. Voluntary Scheduling & Autonomy

Engagement is on a week-to-week basis. Provider designates availability within the platform and voluntarily elects whether to accept job opportunities. There are no penalties, fines, or reductions in opportunities for declining requests. ServiceBookr does not algorithmically prioritize or penalize providers based on acceptance rates or schedule availability.

B3. Expenses & Equipment

Provider supplies all necessary equipment, transportation, tools, phones, and software to perform services. Any client-specific software or credentials provided by ServiceBookr remain Company property.

B4. Compensation & Tax Responsibility

Provider is compensated at agreed fixed rates per completed service deliverable. Provider submits weekly invoices processed net-30 days upon task completion documentation. No taxes are withheld, and Provider receives an annual IRS Form 1099-NEC as required by law.

B5. Non-Solicitation & Confidentiality

During engagement and for six (6) months following termination, Provider agrees not to directly solicit active clients introduced to Provider through ServiceBookr outside the platform. All client contact details and platform data remain confidential property of Karls Technology. Provider retains the absolute right to advertise, solicit, and perform services for the general public and non-ServiceBookr clients at all times.

B6. Breach & Cost Recovery

In the event of a proven material breach of this Agreement by Provider, Karls Technology reserves the right to recover direct documented expenses incurred, including client refund costs, replacement subcontractor expenses, administrative fees, and reasonable attorney fees.

Part C - Platform & App Terms

C1. App Access & Account Security

Users and Providers are responsible for maintaining the confidentiality of their login credentials. Karls Technology is not liable for losses caused by unauthorized account access.

C2. Non-Exclusivity

Use of the ServiceBookr software or mobile application does not create an exclusive relationship. Providers are free to utilize other platforms, apps, and services.

C3. Intellectual Property

All software, code, logos, and content within the ServiceBookr app and platform are the exclusive property of Karls Technology and protected by intellectual property laws. Users receive a limited, revocable license to use the app solely for marketplace activities.

C4. Disclaimers & Limitation of Liability

The app and platform are provided "as is" without warranty of any kind. To the maximum extent permitted by law, Karls Technology shall not be liable for indirect, incidental, or consequential damages resulting from app use or platform service requests.

C5. Governing Law & Jurisdiction

These Terms and the Independent Contractor Agreement shall be governed by the laws of the State of Missouri, without regard to conflict of law principles. Any legal claim or dispute shall be brought exclusively in the state or federal courts located in Greene County, Missouri.
